1. General Overview

These Terms and Conditions (hereinafter referred to as "Terms") govern the use of the recruitment and consulting services provided by Foxgenix Global Services (hereinafter referred to as "Company"). By accessing or using our website and services, clients and job seekers agree to abide by these Terms. If you do not agree with these Terms, please do not use our services, portal or website.

2. Terms for Clients

2.1 Service Agreement

  • Clients will select from the service models provided by the Company, including but not limited to Subscription-Based, Pay-Per-Hire, On-Demand Hiring, and Consultation Services. The specific services and corresponding fees will be detailed in a Service Agreement prior to the commencement of services.

2.2 Payment Terms

  • All payments for services rendered are due as per the schedule outlined in the Service Agreement (monthly, per hire, or per hour).
  • Clients acknowledge that additional fees may be incurred for services requested beyond the originally agreed scope. Clients are responsible for all applicable taxes related to the services.
  • Any payment not received by the due date will incur interest charges at the rate of [insert percentage]% per month until the outstanding amount is paid in full.

2.3 Candidate Selection and Placement

  • While the Company will present candidate profiles based on the client’s specifications, the final hiring decisions rest solely with the client. The Company shall not be liable for any adverse outcomes resulting from the client’s hiring decisions.

2.4 Confidentiality

  • Clients are required to maintain the confidentiality of all proprietary information received from the Company, including candidate data and pricing structures.
  • The Company agrees to treat all client information as confidential and will not disclose it to third parties without the client’s prior written consent, except as required by law.

2.5 Limitation of Liability

  • The Company shall not be liable for any indirect, incidental, or consequential damages arising from the use of its services. The Company’s total liability shall not exceed the fees paid by the client for the specific service that gave rise to the claim.
  • Clients agree to indemnify and hold harmless the Company from any claims, damages, losses, or expenses arising out of their use of the services.

2.6 Termination

  • Either party may terminate the Service Agreement with written notice of 30 days if the other party breaches any terms herein and fails to remedy such breach within the notice period.
  • Upon termination, all outstanding fees for services rendered up to the termination date shall be payable by the client.

3. Terms for Job Seekers

3.1 No Fees

  • Job seekers can utilize the Company's recruitment services without incurring any fees. The Company does not charge job seekers for applying to jobs or accessing services.

3.2 Application Process

  • Job seekers are required to provide accurate and complete information when applying for positions. The submission of false or misleading information may result in disqualification from consideration for roles.
  • By submitting an application, job seekers grant the Company permission to share their information with potential employers as part of the recruitment process.

3.3 Candidate Selection

  • The Company serves as an intermediary between job seekers and employers. The decision to hire is at the sole discretion of the employers, and the Company does not guarantee job placements or outcomes for job seekers.
  • Job seekers will receive notifications regarding the status of their applications and other relevant updates from the Company.

3.4 Privacy and Data Protection

  • The Company is committed to protecting the privacy of job seekers and will handle personal data in accordance with applicable data protection laws. Job seekers may request the removal of their personal information from the Company’s records at any time.

3.5 Limitation of Liability

  • The Company shall not be responsible for any direct, indirect, incidental, or consequential damages resulting from the job application process, including any offers or rejections from potential employers.
  • Job seekers acknowledge that the Company does not guarantee any specific outcomes, success rates, or placements.

4. Governing Law

These Terms shall be governed by and construed in accordance with the laws of government of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of State of Maharashtra.

5. Amendments

The Company reserves the right to modify these Terms at any time. Clients and job seekers will be notified of any significant changes, and continued use of the services after such modifications will constitute acceptance of the new Terms.
